同性伴侶註記3951對 雙北台中最多
（中央社記者劉麗榮、劉冠廷台北8日電）根據內政部統計，3年多來全國已有3951對同性伴侶註記，最多的前三名為台北市、新北市和台中市。民進黨立委尤美女說，不能單靠縣市政府的善意，一定要同性婚姻合法化，才能保障權益。
內政部官員表示，從施行同性註記以來，六都包括台北市共有818對、新北市743對、台中市694對、桃園市442對、台南市238對與高雄市173對，全台已有3951對完成註記。
高雄市在104年5月20日率全國之先辦理同性伴侶註記後，全國多數縣市陸續跟進，內政部去年並開放跨區受理。
長期關注同婚的民進黨立委尤美女今天表示，這數目不算少，但當然有很多人可能覺得大法官會議解釋後，就直接等著結婚就好，不用去註記。
尤美女說，註記並沒有法律的效果，雖然勞動部與衛福部表達有註記可以簽署手術同意書等伴侶權益，但是有的縣市還是不給註記，所以一定要同性婚姻合法化，才能得到真正的權利，否則都只是各縣市政府的善意。
她也說，若只是善意，卻拿不到任何的權益，去註記等於出櫃，可能就會馬上被歧視或霸凌，這就是為什麼同志需要同性婚姻。
大法官748號解釋，認定現行民法沒有保障同性婚姻違憲，立法機關應在兩年內，也就是明年5月24日前完成立法保障同性婚姻，但對於是要立專法還是修民法，各界意見不一，甚至引發對立。
今年九合一選舉合併舉行公投，幸福盟提出的「你是否同意民法婚姻規定應限定在一男一女的結合？」等愛家3公投過關，依公投法規定，行政院已表示，明年3月前將提出保障同性婚姻的專法草案，送交立法院審議。（編輯：張均懋）1071208
5年豁免條款有望入法 居住證不涉課稅！陸釋定心丸 台胞續享個稅優惠

大陸今年8月底拍板通過的《個人所得稅法》新制明年上路，將全球課稅的大陸「稅務居民」判定標準從住滿1年調整為183天，讓台胞台商擔心課稅力道加重。但大陸財政部、國家稅務總局相關負責人近日也釋出定心丸，指出為保持政策穩定性，下一步落實新個稅法時，將考慮繼續對境外人士包括港澳台人士作出優惠安排。
雖沒有明說是哪些優惠，但該負責人進一步說明，現行大陸個稅法實施條例對境外人士納稅有特殊優惠規定。也就是在大陸境內雖無住所、但居住1年以上、5年以下的個人，境外收入所得在境外支付的部分，無須在大陸繳納個人所得稅。
對台商趨向正面優待
實際上這就是台商所謂的「5年豁免條款」。過去一些長期待在大陸工作的台商、台幹，為避免變成大陸稅務居民，在「5年豁免條款」保障下，多半會採用每5年離境回台30天的「坐月子」方式規避，藉此避免稅負加重。這也是為防止被同時視為台灣、大陸稅務居民、慘遭雙邊課稅的窘境。
而個稅法8月底新制定案後，由於從前「5年豁免條款」並未進入母法，而是列入個稅法實施條例當中，也讓港澳台人士紛紛擔憂是否能夠延續。假設「5年豁免條款」未能續存、加上新制緊縮到住滿183天即算「稅務居民」，台商台幹如果不想被全球課稅，將變成每年必須一半時間離開大陸。
但大陸官方態度仍舊對台商趨於正面優待。由《旺報》9月底所舉辦的台商維權座談會上，安永（中國）企業諮詢公司深圳公司合夥人彭紹龍就透露，日前北京稅務部門邀請多家大型會計師事務所進行研商，預料最快10月底個稅法實施條例將出爐，更對「5年豁免條款」的持續實施表示樂觀看待。
新稅法納入優惠安排
隨後大陸財政部、國家稅務總局在9月30日記者會上接受訪問時也對外表態，為保持政策穩定性，下一步落實新個稅法時，將考慮繼續對境外人士包括港澳台作出優惠安排。
此外，也有在陸台商會長私下透露，雖然還沒看到個稅法實施條例全文，但有接觸到大綱內容，也已聽到「5年豁免條款」繼續維持的風聲。
